The Lubbock Ordinance Outlawing Abortion
On May 1, 2021, the voters of the city of Lubbock, Texas (population 250,000+) overwhelmingly passed an ordinance outlawing abortion.
The essence of the ordinance’s enforcement mechanisms run along two parallel tracks: (1) Anyone and everyone aiding in an abortion, other than the mother, faces a civil fine of up to $2,000 per abortion. The civil fine is not enforceable until Roe v. Wade is overturned, but the total amount continues to accrue until then. (2) The aborted child's mother, father, grandparents, siblings and half-siblings may sue anyone and everyone aiding in the abortion (other than the mother) for compensatory damages, punitive damages, and costs and attorney fees.
